Terms of Service

These Terms govern access to and use of FlowAgent, including our real estate CRM, AI communication, scheduling, voice, email, and integration features.

Important draft notice

These Terms are a version 1 operational draft and must be reviewed by qualified counsel before relying on them for paid customers. The legal entity name, mailing address, governing law, dispute process, billing terms, and any DPA or enterprise terms are still pending.

Using FlowAgent

FlowAgent is intended for real estate professionals and their teams. You must provide accurate account information, keep credentials secure, and use the service only for lawful business purposes. You are responsible for all activity in your account and for configuring team access appropriately.

Service scope and eligibility

FlowAgent is offered only to real estate professionals operating in the United States and English-speaking Canada, and the service is provided in English only. FlowAgent is not offered for use in Quebec, the European Union, the EEA, or the United Kingdom, and you may not use it to contact leads located in those regions.

You are responsible for ensuring that your use of FlowAgent complies with the laws of the jurisdictions where you and your leads are located, including any language, consent, privacy, and calling rules that apply there. Support for additional regions or languages may be added later and, if so, will be reflected in these Terms.

Customer data and permissions

You retain ownership of your customer, lead, listing, communication, calendar, and CRM data. You grant FlowAgent permission to process that data as needed to provide, secure, support, and improve the service and to operate features you enable.

You represent that you have the rights, notices, consents, and authority needed to submit data to FlowAgent and to connect third-party accounts such as email, calendar, telephony, AI, and CRM providers.

AI features

FlowAgent may generate messages, summaries, classifications, call scripts, and recommendations using AI. AI output may be inaccurate, incomplete, delayed, or inappropriate for a particular situation. You are responsible for reviewing AI output, supervising automation, honoring lead preferences, and deciding when human review is required.

FlowAgent is not a lawyer, broker, compliance officer, or Fair Housing advisor. The service includes guardrails, but those guardrails do not replace your professional judgement or legal obligations.

Communications compliance

You are responsible for ensuring that calls, texts, emails, recordings, AI-bot disclosures, and follow-ups sent through FlowAgent comply with all applicable laws and platform rules.

  • Use outbound AI calling only where you have legally sufficient consent, including prior express written consent where required.
  • Maintain and honor internal do-not-call, unsubscribe, opt-out, and suppression requests.
  • Comply with TCPA, TSR, CAN-SPAM, state telemarketing laws, call recording laws, AI disclosure laws, Fair Housing laws, real estate licensing rules, and brokerage policies.
  • Do not use FlowAgent to send misleading, harassing, discriminatory, unlawful, or high-risk communications.
  • Do not disable, bypass, or misrepresent compliance controls such as consent checks, DNC checks, quiet hours, unsubscribe handling, or recording disclosures.

Your role: sender and caller of record

FlowAgent is a tool that acts on your instructions and configuration. For every call, text, email, recording, and follow-up created or sent through the service, you are the sender, the caller, and the party of record, and FlowAgent acts on your behalf and at your direction. You, not FlowAgent, decide who is contacted, on what basis, and with what consent.

You represent and warrant that, before enabling automated outreach to any lead, you have a lawful basis and any consent required to contact that person on the chosen channel, and that you will promptly honor every opt-out, unsubscribe, and do-not-contact request. FlowAgent provides controls to help, including consent checks, quiet hours, DNC checks, unsubscribe and suppression handling, and recording disclosures, but you remain solely responsible for lawful use and for the content and timing of your communications.

Third-party services

FlowAgent can connect to third-party services such as Supabase, Google, Microsoft, Vapi, Twilio, Resend, OpenAI, Follow Up Boss, Sentry, and other providers. Your use of those integrations may be subject to the third party provider terms and privacy practices. FlowAgent is not responsible for third-party outages, policy changes, or data handling outside our control.

Acceptable use

  • Do not use FlowAgent to violate law, infringe rights, scrape data unlawfully, or send spam.
  • Do not attempt to reverse engineer, overload, attack, interfere with, or bypass security controls.
  • Do not upload malicious code or use the service to generate deceptive, discriminatory, or abusive content.
  • Do not use FlowAgent for emergency communications, medical advice, legal advice, financial advice, or other regulated decisions outside the supported real estate workflow.

Fees and billing

Fees, plan limits, trials, usage charges, taxes, refunds, cancellation rights, and renewal terms should be stated in the applicable order form, invoice, checkout page, or plan description. FlowAgent should use a third-party payment processor if card billing is enabled. Billing terms are pending final product and legal review.

Service changes and availability

We may update, suspend, or discontinue features, integrations, models, workflows, or limits as the product evolves or as required for safety, security, provider policy, compliance, or operational reasons. We work to keep FlowAgent available, but we do not guarantee uninterrupted or error-free service.

Intellectual property

FlowAgent and its software, designs, documentation, workflows, and related materials are owned by FlowAgent or its licensors. Subject to these Terms, you receive a limited, non-exclusive, non-transferable right to use the service for your internal business purposes.

Indemnification

To the maximum extent permitted by law, you will defend, indemnify, and hold harmless FlowAgent and its owners, operators, and providers from and against any claims, demands, fines, penalties, losses, and costs, including reasonable legal fees, arising out of or related to: the communications and outreach you send through the service; your leads, contacts, and customer data; your consent, do-not-call, recording, disclosure, and other compliance obligations; your use of connected third-party accounts; or your breach of these Terms or applicable law.

This allocation reflects that you are the sender and caller of record and that FlowAgent acts on your instructions. Final indemnity, liability cap, dispute resolution, and governing law language must be confirmed by counsel before production use.

Disclaimers and limits

To the maximum extent permitted by law, FlowAgent is provided as is and as available. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that AI output, compliance controls, communications, integrations, or analytics will be accurate or sufficient for your legal obligations.

Liability limits, exclusions, dispute resolution, and governing law must be finalized by counsel before production use.
